Pizarro

Pizarro licence

In short: Pizarro is source-available software, not open source. You can read the code, but you need a licence to use it. If you are an individual running it on your own server for personal, household or family purposes, with no commercial or professional aim, it is free. If you use it in a company, as a professional or freelancer, or in any organisation (including associations, NGOs, public bodies and schools), you need a commercial licence: it is a one-time payment per server, includes all future updates and does not include support. This summary is for guidance only and does not replace the licence text, which is the one that applies.

This is a translation of the Spanish licence above. In case of any discrepancy between the two versions, the Spanish version prevails.

1. Ownership

Pizarro (the "Software"), its source code, its documentation and its graphic elements are works protected by intellectual property law. The author of Pizarro (the "Author") retains all rights not expressly granted in this licence. The fact that the code is publicly visible, for example in a repository, does not grant any right to use, copy, modify or distribute it beyond those this licence recognises.

2. Definitions

  • Installation: a production instance of the Software, with its database, deployed on a server (physical or virtual) or in a hosting environment. Copies intended only for testing, development, backup or disaster recovery of a licensed installation do not count as additional installations as long as they are not used in production.
  • Personal use: use by an individual for personal, household or family purposes, with no commercial or professional aim, on servers that individual controls.
  • Business or professional use: any use for commercial or professional purposes, or within an organisation, whether or not for profit, including freelancers and independent professionals. Associations, NGOs, foundations, public bodies and educational institutions are treated as organisations for this purpose and need a commercial licence, without exception: any use that is not personal needs a licence.

3. Free personal use

Individuals may install and use the Software free of charge for personal use, on their own servers, and may modify it for that same use, subject to the prohibitions in section 5.

4. Commercial licence

Business or professional use requires a commercial licence. The commercial licence:

  • is paid once for each installation (server), with no recurring fees;
  • entitles you to use the Software indefinitely on that installation, with as many users as the application itself allows;
  • entitles you to receive and use all future updates of the Software at no additional cost;
  • does not include support, maintenance, installation, configuration or any guarantee of availability, unless the Author agrees to them separately in writing;
  • is not transferable to another person or organisation without the Author's written authorisation, and covers only the person or organisation that obtains it.

To obtain one, see section 10.

5. Prohibitions

Without the Author's written authorisation, it is not permitted to:

  • sell, resell, rent or sublicense the Software;
  • redistribute copies of the Software, modified or unmodified, by any means;
  • offer the Software as a service to third parties (for example, as SaaS or hosting for customers);
  • remove or alter authorship and licence notices;
  • circumvent, disable or tamper with the technical limits or mechanisms of the application.

Modifying the Software for your own use within the limits of this licence is permitted.

6. Use without a licence

Using the Software for business or professional purposes without the corresponding commercial licence is not authorised. Such use constitutes an infringement of the Author's intellectual property rights and entitles the Author to bring the civil and, where applicable, criminal legal actions available to them, including a claim for damages and for the price of the unpaid licences, together with any costs and expenses that may be due. The Author prefers to resolve these situations by the purchase of a licence, and anyone using the Software without one may get in touch to do so.

7. No warranty and limitation of liability

The Software is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, absence of errors or availability. Whoever installs it is responsible for their server, their backups and the data it stores. To the extent permitted by law, the Author is not liable for indirect damages, loss of profit or loss of data arising from the use of, or inability to use, the Software, except in cases of wilful misconduct or gross negligence. Nothing in this licence limits the rights that the law grants to consumers and users and that cannot be waived.

8. Term and termination

This licence lasts as long as its conditions are met. If they are breached, the rights granted end automatically for the party in breach, without prejudice to any other actions available to the Author. The commercial licence does not expire with the passage of time.

9. Governing law and jurisdiction

This licence is governed by Spanish law. For any dispute, the parties submit to the courts with jurisdiction under the law, respecting the forum that applies to consumers and users.

10. How to obtain a licence

To obtain a commercial licence, write to the Author at the email shown on Pizarro's presentation page or in the project repository. The price is the one published on the presentation page at the time of purchase. Payment is by card, and an invoice is issued with the details of the purchasing company or person (an ID or tax number is optional for individuals).
